Identity Designs Co. Policies, Terms and Conditions

Branding/Identity Design:

Identity Designs Co. will provide: 3 -6 full color initial design concepts for the project described above. After initial graphic design concepts are provided, up to 3 additional rounds of revisions are provided. Confirmation of layout approvals must be made by email. Further additions beyond this will be billed at the hourly rate of $50/ hr.

Property Rights. The elements of design work for the project remain the designer’s property whether or not the project is executed. If client chooses to terminate the website at any time in the future, Identity Designs Co. reserves the right to retain the rights for usage.

Approval of Final Artwork. The Client shall proofread and approve all final type before the production of artwork. Final proof will include artwork, size, shipping address and quantity. The email verification of the Client’s Representative shall be conclusive as to the approval of all artwork, drawings and other items prior to their release for printing, fabrication, or installation. All requests must be made in writing. Identity Designs Co. does not offer proofreading, editing or copywriting in designs unless specifically stated and purchased in the scope of the project. NO refunds or reprints are given after a final approved design has gone to print. If there are mistakes with the design, they will be considered the result of omission by the client, unless otherwise proven.

Rights. Other than for the promotional use of the Designer, all services provided by the Designer shall be for the exclusive use of the Clients said purposes ONLY. Designs may not be used for other promotional items, website or printed materials without permission. Upon payment of all fees and expenses, reproduction rights for all approved final designs created by the Designer for this project shall be outlined in the original estimate. For further usage, price will be based on a case by case basis.

Ownership. All drawings, artwork, specifications, and other visual presentation materials remain the property of the Designer to show in printed or online portfolios for the length of the lifetime of the artist. All preliminary concepts and visual presentations produced by the Designer remain the property of the Designer but may also be used by the Client without the written permission of the Designer.

Liability of Designer. The Designer shall take reasonable precautions to safeguard original or other materials provided by the Client. The Designer shall, however, not be liable for any damage to, or loss of any material provided by the Client, including artwork, photographs, or manuscripts, other than or on account of willful neglect or gross negligence of the Designer. Although Identity Designs Co. may recommend that the client utilize the services of various trades people, Identity Designs Co. shall have no liability for payment to these trades people, nor shall Identity Designs Co. have liability as a result of any services or product or materials by said trades people

Payment of Fees. Fees are due and payable on the following schedule: 50% deposit, 50% upon completion. Payment in full is due before final designs are provided to client.

Termination. Either party may terminate this Agreement upon giving written notice to the other as specified below. Upon termination the Designer may retain any initial payment and the Client shall pay the Designer for all hours expended on the Project, up to the date of termination, at the Designer’s standard rates together with all other amounts due hereunder.

Refunds. Once a project has been designed in full and completed according to the agreed upon project, no refunds are given after the final design has been approved. If more than the agreed upon number of layouts are provided along with revisions no deposit is refunded. If work has begun on your design, deposit is not refunded. Once a design has been sent to print, there can be no additional changes. If you require a change after printing, you must pay the full price for the first printing, as well as the price for the reprinting of the design if the error is on the part of the client. If print color is poor, or an error is made on our part, your order will be reprinted for you at no cost. Proof of error on the part of Identity Designs Co. must be firmly established and proven with evidence, prior to any refund or reprint is given. Refunds for shipping and printing are not given.

Timelines. After deposit is given and project has been outlined, we will provide you will an estimated turnaround time. The amount of time it takes to fully complete your design depends on how quickly you communicate with us about the revisions you would like, as well as payment of fees in a timely manner. If you decide to take a break from the project without informing Identity Designs, and then return a month later, we can not guarantee you will still be first in line for design work. We will do out best to work you back into the schedule as time permits. Clients that disappear for longer than 1 month, the project will be cancelled or postponed indefinitely, and deposits withheld for work completed up to that point.

Maintenance/Revisions. After completion of a website project, revision work is billed at an hourly rate of $50/hr and must be paid in advance prior to any revision work commencing.

Notes:

- Branding/design does not include printing costs or shipping.

- Branding/design does not include marketing, public relations, animation, or photography.

Website Design:

Search Engines. Identity Designs Co. will not be responsible for search engine submission, search engine optimization or website marketing or any kind, unless otherwise clearly stated in the scope of the project.

Timeline: For websites turnaround time is from the date we have ALL CONTENT FROM YOU. Without content from you, the design job can not be fully understood or planned out.
